In the Indian real estate sector, RERA stands for the Real Estate (Regulation and Development) Act. Enacted in 2016, it was designed to transform the industry into a more transparent, accountable, and buyer-friendly market.
Each state has its own specific RERA authority (e.g., HRERA for Haryana, Delhi RERA for Delhi), which oversees all residential and commercial projects to ensure developers follow the rules.
Principal Advantages for Homebuyers
The Act shifted the power balance back toward the consumer. Here are the primary benefits:
1. Transparency in “Carpet Area”
Before RERA, developers often used vague terms like “Super Built-up Area” to inflate prices. Developers must quote the price based on the carpet area (the actual usable area within the walls), so you know exactly what you are paying for.
2. Financial Security (Escrow Accounts)
Developers are required to deposit 70% of the funds collected from buyers into a separate escrow account. This money can exclusively be used for the construction and land costs of that specific project, preventing the common practice of diverting funds to start new projects.
3. Protection Against Delays
If a project is delayed, the developer is legally obligated to pay the buyer interest for every month of the delay. Alternatively, if the buyer chooses to withdraw from the project, the developer must refund the entire amount paid plus interest.
4. Quality Assurance
RERA provides a five-year warranty period. If any structural defects or quality issues arise within five years of handing over possession, the developer must fix them within 30 days at no extra cost to the buyer.
5. Advance Payment Cap
A developer cannot ask for more than 10% of the property cost as an advance or application fee before entering into a formal registered agreement for sale.
Advantages for Developers and Agents
Although it appears to prioritize the buyer, RERA also enhances the professionalism of the industry.
- Increased Trust: Buyers are more confident investing in RERA-registered projects, leading to better sales for honest developers.
- Standardization: It brings a uniform set of rules to the industry, weeding out “fly-by-night” operators.
- Mandatory Registration: Real estate agents must also register with RERA, ensuring that only verified professionals are mediating deals.
Pro Tip: Always verify the RERA registration number on the official state portal before visiting a site or making a payment. A lack of project registration raises a significant red flag.
